Justiça obriga a Unimed a retirar o reajuste por faixa etária para quem faz 60 anos.
Uma liminar deferida na 11ª Vara Cível de Vitória determina que todas as operadoras Unimed no Estado não cobrem mais reajuste por faixa etária de beneficiários que completarem 60 anos.
A decisão saiu em resposta a uma ação civil pública proposta pelo Procon Estadual do ES que entrou com ações pelo mesmo motivo contra outras operadoras de plano de saúde do Estado.
No documento, a Justiça obriga as operadoras da Unimed a não reajustarem seus valores por mudança de faixa etária dos consumidores que vieram a completar 60 anos de idade, e dá um prazo de 20 dias para que a empresa cesse a cobrança do aumento.
Caso a decisão seja descumprida, será aplicada multa diária de R$100,00 por contrato.
De acordo com o Diretor Jurídico do Procon Estadual, Itamar Daumas Junior, a ação contra as empresas se deve não só pelo comprimento do que determina o Estatuto do Idoso, mas também pela Lei dos Planos de Saúde e a própria Constituição Federal.
"O Estatuto do Idoso proíbe aumento a partir de 60 anos por mudança de faixa etária, mas os planos de saúde compreendem que a regra só é aplicada aos contratos assinados até 2004, quando o estatuto foi criado. Queremos deixar claro que a lei é para todos, e que vale para qualquer consumidor, independente de quando ele tenha asinado o contrato com a operadora." explica.
O Diretor Jurídico do Procon Estadual destacou ainda que o Consumidor também tem direito a receber em dobro, o que foi pago indevidamente.
"Os que tiveram de pagar o reajuste por faixa etária, após completarem 60 anos, tem direito a receber em dobro, as parcelas cobradas com aumento indevido", frisou o diretor.
O Procon ingressou na Justiça contra a Unimed e outras operadoras. Segundo Daumas Junior, devem sair respostas a ações contra outras operadoras."Uma das operadoras reajustou de R$199,21 para R$491,79. Um absurdo", ressaltou.
